Imagine you are driving as you normally do, worried about your everyday tasks; work, school, the kids, mortgage payments, your health, any number of issues. When you see blue lights behind you, your first thought is “they must be pulling someone else over.” Unfortunately, they are pulling you over.

Just like that your life can change. It can be easy to get caught up in what you could have done, where your insurance card might be, and a million other things. The most important thing to do is to not panic! Remember that the police officer is just doing his or her job. Remain polite and cooperative!

Once the officer's stop is concluded, the questions you should be asking yourself are:

  1. How many points could go on my license?
  2. How many points could go on my insurance?
  3. Can I lose my license?
  4. Can I go to jail?
  5. Do I need an attorney?

How Many Points Could Go on Your License or Insurance

These questions can depend on a number of factors. If you are convicted of a traffic offense in the State of North Carolina, points are assigned to your driver’s license that stay on your record for three years; an accumulation of a certain number of points may result in license revocation. The North Carolina Driver’s Handbook has a complete list of points. Some of the offenses are listed below:

  • Failure to restrain a child in a restraint or seat belt = 2 points.
  • Speeding in a school zone = 3 points.
  • Speeding more than 55 = 3 points.
  • Stop sign violation or red light =3 points.
  • Failure to yield the right of way = 3 points.
  • Failure to yield to a bicycle or a pedestrian = 4 points.
  • Driving on wrong side of the road = 4 points.
  • Following to closely = 4 points.
  • Passing a stopped school bus = 5 points.

If you accumulate 7 or more points, the State may require you to attend a driver improvement class. If you accumulate 12 or more points within a 3-year period, they can and often do suspend your license. Suspension will result in a driver’s license restoration fee before you can drive again.

If you are convicted, you can be certain that your insurance rates will increase as a result. The North Carolina Safe Driver Incentive plan was created to motivate drivers to drive safely through a financial incentive. Simply stated, if you get insurance points your insurance premium will increase!

  • Prearranged speeding = 12 insurance points = 340% increase or premium.
  • Speeding in a school zone = 4 insurance points = 80% increase of insurance.
  • Speeding 10 mph over in a 55 or greater mph zone = 2 points and 45 % increase.
  • Driving while Impaired (DWI) = 12 insurance points = 340% increase.
  • Speeding more than 75 mph in a zone less than 70 mph = 4 points = 80% increase
  • Speeding greater than 80 mph in a 70-mph zone = 4 points = 80% increase.
  • Speeding 10 mph or less if the limit is 55 or higher = 2 points and 45% increase.
  • Speeding 10 mph or less if the speed limit is less than 55 = 2 points = 45% increase.
  • Following too closely = 2 points and 45% increase.
  • Passing a stopped school bus =4 points = 80% increase.

The more insurance points you accumulate, the higher your premium will be.

Can You Lose Your License or Go to Jail After a Traffic Ticket?

The answer to both questions is "maybe" — some traffic offenses can result in an arrest, conviction, jail, and/or probation. It depends on the nature of the stop, what you were doing to warrant the stop, what the officer might find when he/she stops you, your behavior at the scene, and a number of other factors.

How do we minimize the chances of this happening?
